The regulatory changes introduced by the Italian Crisis and Insolvency Code have profoundly reshaped the tools available for managing business distress. Drawing on its consolidated experience in the former bankruptcy law framework, the Firm is able to apply these new instruments effectively and with a practical, solution-oriented approach.
We support entrepreneurs and companies in managing situations of financial distress or insolvency, identifying the most appropriate course of action based on the specific circumstances. Our assistance includes negotiations with creditors, moratorium agreements, access to negotiated crisis settlement procedures, the preparation of recovery and restructuring plans, and access to the various arrangements available under Italian insolvency law, including minor composition procedures, liquidation-based arrangements and arrangements aimed at business continuity, whether direct or indirect.
Professionals within the Firm have held several appointments as Bankruptcy Trustees and Liquidation Commissioners for entities and cooperative companies in compulsory administrative liquidation proceedings, including appointments made directly by the Italian Ministry of Enterprises and Made in Italy. The Firm’s professional is also currently included in the ministerial register of Liquidation Commissioners.
Where the crisis has become irreversible, we assist businesses in the preliminary stages and in filing for judicial liquidation, as well as in assessing any subsequent composition proposals within judicial liquidation proceedings.
The Firm has also developed specific experience in over-indebtedness procedures, which apply to parties not subject to judicial liquidation proceedings under the Italian system.
